THE HONOURABLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.16600 OF 2019 ORDER:

Heard learned counsel for the petitioners, learned standing counsel for respondent No.1 and learned Government Pleader for Labour.

This writ petition is filed challenging the docket order of Labour Court dated 15.05.2019 in E.P. filed in I.D.No.30 of 2003 directing the petitioners to deposit 1/4th of the E.P. amount claimed by the decree holder.

Learned counsel for the petitioners sought to contend that in fact amount was deposited, but according to the assessment of the petitioners, 1/4th amount comes to Rs.3,42,256/- but Labour Court is insisting to deposit higher amount. 4.

The order of the Labour Court is clear with a direction to deposit 1/4th of the E.P. amount and the 1/4th of the E.P. amount arrived at was Rs.3,42,256/-. Therefore, the petitioners have to deposit the said amount and not less than that amount. 5.

Having regard to the facts of this case and the award passed by the Labour Court in I.D.No.30 of 2003 dated 04.09.2017, I do not see any error in the docket order passed by the Labour Court dated 15.05.2019 6.

Granting two weeks time to the petitioners to deposit the said amount, the Writ Petition is disposed of with liberty to the petitioners to raise all pleas as available in the pending E.P. The employee is permitted to withdraw the amount deposited by the

- 2 - petitioners. Pending miscellaneous petitions, if any, shall stand closed.
