HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.41717 OF 2016 ORDER:

The present writ petition is filed by the petitioner seeking to declare the action of the respondents in not taking action in terms of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Rules vide issued in G.S.R. No.316 (E), Ministry of Welfare, New Delhi, dated 31.03.1995, Section 4, Sub-Section 5, as illegal and arbitrary. Heard and perused the material available on record. The grievance of the petitioner is that though he made a representation on 23.06.2016 before the District Collector, Adilabad - 4th respondent, for appointment of a Special Public Prosecutor to conduct trial in his case i.e. Spl.S.C. No.21 of 2012 on the file of the Special Judge under SC/ ST (PoA) Act, the 4th respondent is not taking any action on the same.

Considering the circumstances of the case and also the grievance of the petitioner, without going into merits of the case, the 4th respondent is directed to dispose of the representation, dated 23.06.2016, made by the petitioner, within a period of four (4) weeks from the date of receipt of a copy of this order. With the above directions, the Writ Petition is disposed of. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
