This Criminal Petition under Sections 438 of the Code of Criminal Procedure, 1973 (for short 'Cr.P.C.'), is filed to enlarge the petitioner/ A-6 on pre-arrest bail since he is apprehending arrest in connection with Crime No.202 of 2016 of Asif Nagar Police Station, Hyderabad District, registered for the offences punishable under Sections 420, 468, 471, 506 r/ w 34 of IPC.

The sum and substance of the prosecution case is that the petitioner along with other accused forged and fabricated the documents for the purpose of cheating for which they are liable for the offences mentioned supra.

According to the learned Public Prosecutor for the State of Telangana, a notice under Section 41-A of Cr.P.C. was issued, but the petitioner did not appear in response to the notice and thus, the petitioner-A-6 avoided his appearance before the police and failed to co-operate with the police. In such a case, this Court cannot exercise its discretion to grant pre-arrest bail to the petitioner. Hence, the criminal petition is dismissed.

Consequently, miscellaneous applications pending if any, shall also stand dismissed.
