THE HON'BLE SRI JUSTICE A.V.SESHA SAI W.P.No.6405 of 2015 ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India seeking following relief:- ".... to issue any writ or direction more particularly one in the nature of Writ of Mandamus declaring the action of the 3rd respondent in interfering with the civil disputes between petitioner and the respondents 4 and 5 with regard to the lands in Sy.Nos.193/A, 196, 197, 191, 194, 195, 198 and 200 admeasuring Ac.42.12 guntas, the said lands are situated in Palgutta Village of Chevella Mandal, Ranga Reddy District as illegal and arbitrary and consequently direct the said respondent not to interfere with our civil disputes in the interest of justice and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."

Heard Sri K.Ramakanth Reddy, learned counsel representing Sri Raja Reddy Koneti, learned counsel for the petitioner and the learned Government Pleader for Home (TG) for respondents 1 to 3.

When the matter is taken up for hearing, learned Government Pleader has placed on record the written instructions, dated 12.06.2015 furnished by the Station House Officer, Chavella Police Station, Ranga Reddy District. In the said instructions, it is stated that on 09.02.2015 one Mr.Syed Anwar lodged a complaint to the Police stating that the petitioner herein along with his henchmen criminally trespassed into the land in question, broken the gate, stolen the agricultural equipments and threatened the watchman with dire consequences if he did not vacate the land in question. On receipt of the said complaint, police registered a case in Cr.No.26 of 2015 for the offences under Sections 427, 447 and 506 IPC and took up investigation and during the course of investigation, the respondent police examined and recorded the statement of the complainant under Section 161 Cr.P.C. and visited the scene of offence

and subsequently, conducted scene of offence panchanama in the presence of two mediators and drawn a rough sketch. It is further stated that on 20.05.2015 the respondent police filed a charge-sheet before the Judicial First Class Magistrate, Chevalla, Ranga Reddy District. The instructions further denied the interference of the respondent police in the civil dispute between the petitioner and respondents 4 and 5. It is also stated that after submission of the charge-sheet, the police has no need to interfere with the civil dispute pending between the petitioner and respondents 4 and 5.

On noticing the said instructions, learned counsel for the petitioner has requested this Court to record the said instructions and dispose of the writ petition.

In view of the above, the writ petition is disposed of recording the above referred written instructions furnished by the Station House Officer, Chevella Police Station, Ranga Reddy District.
