THE HONOURABLE SRI JUSTICE RAJA ELANGO Criminal Petition No.6365 of 2016 ORDER:

This Criminal Petition is filed under Section 482 of Code of Criminal Procedure (Cr.P.C) by the petitioner seeking to quash the proceedings in F.I.R.No.771 of 2011 on the file of the Madhapur Police Station, Cyberabad District, for the offence under Sections 498-A and 306 I.P.C.

When the matter is taken up for hearing, the learned Public Prosecutor submits that investigation in this case had been completed and charge-sheet was also filed, therefore, the cause in the Criminal Petition does not survive for adjudication. Recording the submission made by the learned Public Prosecutor, the Criminal Petition is dismissed as infructuous. However, the petitioner is at liberty to challenge the chargesheet, if he is so advised. Consequently, Miscellaneous Petitions, if any, pending in the Criminal Petition shall stand closed.
