HON'BLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION No. 29127 OF 2016 ORDER:

In this writ petition, the petitioner, who is a conductor in respondent - Corporation, challenges order of suspension, dated 17.08.2016, on various grounds.

When the matter is taken up for consideration, learned counsel for the petitioner informs the Court that on 29.12.2016 the respondent Corporation has passed order of removal of petitioner. However, he sought to contend that due procedure was not followed while passing the order of removal and therefore the petitioner may be given an opportunity to prefer an appeal against the said order. In the instant case, the challenge is only with regard to order of suspension. When once an order of removal is passed, the order of suspension merges into the order of removal.

In view of the subsequent order of removal, the cause in the writ petition does not survive and the writ petition is accordingly dismissed leaving it open to the petitioner to avail such remedies as available in law against the order of removal.
