HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR WRIT PETITION No.2077 of 2016 ORDER:

Heard learned counsel for the petitioner and the learned Government Pleader for Revenue.

This writ petition is filed aggrieved by non-consideration of the stay application filed in appeal SR.No.3/POT/2015. It is stated that the appeal is pending with the 2nd respondent and though he has issued notice in the said appeal on 27-10-2015 requiring the parties to be present for enquiry on 28-11-2015, the appeal was not taken up nor any orders are passed on the stay application. It is also stated that against the same impugned order, various other appeals are pending and W.P.No.40279 of 2015 and batch was filed before this Court with similar grievance and the said batch was disposed of on 11-12-2015.

In view of that, this writ petition is also disposed of in terms of W.P.No.40279 of 2015 and batch, dated 11-12-2015, by observing as follows:- "Since the petitioner's appeal along with stay applications is pending for the last six months, it is appropriate to direct the 2nd respondent to fix an early date within a week from the date of receipt of a copy of this order and pass appropriate orders atleast to the extent of stay petition. Till appropriate orders are passed by the 2nd respondent, status-quo with regard to the present position, existing as on today, shall be maintained."

Miscellaneous petitions, if any, pending shall stand closed. No order as to costs.
