HONB'E SRI JUSTICE CHALLA KODANDARAM WRIT PETITION No.13554 OF 2017 ORDER:

The writ petition is filed challenging the action of the respondent authorities in not taking any action against the illegal constructions made in the terrace of the premises "Venkata Sadan" Municipal Door Nos.1-2-382/1 and 1-2-382/1/A, Domalguda, Hyderabad in spite of the representation dated 5.1.2017 was made by the petitioners.

In the light of the provisions of A.P. Apartments (Promotion of Constructions and Ownership) Act and Rules, 1987 (for short, "the Act"), construction of pent house is prima facie in violation of the provisions of the Act. However, the respondent authorities shall take into consideration of the provisions of the Act and the Rules made there under and considering the complaint made by the petitioners against the unofficial respondents, pass appropriate orders, in accordance with law by following the due process of law, within a period of two weeks from the date of receipt of copy of the order. Accordingly, the writ petition is disposed of directing the respondent authorities to pass appropriate orders on the representation dated 5.1.2017 of the petitioners, in accordance with law by following the due process of law, within a period of two weeks from the date of receipt of copy of the order. No order as to costs. Miscellaneous petitions, if any pending in this writ petition shall stand closed.
