THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.10406 of 2004 ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India seeking a writ of Mandamus, declaring the action of the Respondents in conducting paper IX of JAO Part-II Examination held in December 2000 by giving the questions out of syllabus as arbitrary, discriminatory and illegal and consequently direct the Respondents to award the minimum qualifying 33% marks to the petitioner in paper IX of the said Exam and declare her passed in JAO Part II Exam held in December, 2000 in the light of the judgment dated 23.4.2004 in O.A.No.1436 of 2002 on the file of the Central Administrative Tribunal, Hyderabad Bench at Hyderabad and with all other consequential benefits.

2 When the matter is taken up for hearing, the learned counsel for petitioner submitted that the purpose of filing of the present Writ Petition has become infructuous.

In view of the submission made by the learned counsel for the petitioner, the Writ Petition is dismissed as infructuous. No order as to costs. As a sequel, the miscellaneous petitions, pending in this Writ Petition, if any, shall stand closed.
