THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION NO.30752 OF 2010 ORDER:

This writ petition is filed seeking to issue writ of mandamus declaring the action of the 5th respondent in not sending the 'No Objection Certificate' directly to the 3rd respondent about the classification and availability of land applied by the petitioner for grant of quarry lease as per G.O.Ms.No.181, Industries and Commerce (Mines. I) Department, dated 28-05-1998 for an extent of 1.000 Hectors in Sy.No.124 of 171 of Paleru Village, Bangaru Palyam Mandal, Chittoor District, as illegal, improper and contrary to G.O. and also contrary to Mines & Minerals (Development and Regulation) Act, 1957 and A.P. Minor Mineral Concession Rules, 1966.

2. This Court, vide order, dated 08-12-2010 directed the 5th respondent to send his report on the application of the petitioner to the 3rd respondent-Assistant Director of Mines and Geology, in accordance with G.O.Ms.No.181, dated 28-05-1998.

3. In view of the said interim direction, no further orders are necessary in the present writ petition.

4. Accordingly, the writ petition is dismissed as infructuous. No order as to costs. Miscellaneous petitions, if any pending in this writ petition shall stand closed.
