HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No. 4281 of 2016 ORDER:
Being aggrieved by the issuance of Occupancy Rights Certificates in favour of one Rajendra Kumar Khanna and others on 12.03.1998 in File No.J/1869/1997, the petitioner filed an application dated 30.09.2015 before the 2nd respondent seeking cancellation of the said Occupancy Rights Certificates and alleging inaction of the 2nd respondent, he filed the present writ petition. I am unable to see, how a representation can be considered by the 2nd respondent as sought for by the petitioner, in view of the fact that the Occupancy Rights Certificates were granted under the Andhra Pradesh (Telangana Area) Abolition of Inams Act, 1955 (for short 'the Act') and such statutory certificates can only be subject to a regular appeal under Section 24 of the Act. I am, therefore, unable to grant a Mandamus as sought for. However, the petitioner is at liberty to file an appeal under Section 24 of the Act, if he so desires.
Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.
