THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.8073 of 2016 ORDER:

This Criminal Petition is filed by the petitioners/A-2 & A-3 under Section 438 Cr.P.C. seeking anticipatory bail in Crime No.107 of 2016, on the file of III Town Police Station, Karimnagar District, registered for the offences punishable under Sections 153-A, 295-A, 298, 506 read with 34 IPC.

Heard and perused the material available on record. The allegations against the petitioners are that on 22.05.2016 at 21.00 hours, the accused Pasha along with eight others of Muslim Community, with an intention to promoting enmity between two groups, insulting religion by making gesture while the de facto complainant and others of Hanuman devotees were taking bath at public tap, found at Beat Market and they threatened the de facto complainant and others with dire consequences to kill them if they again take bath near tap.

Learned counsel for the petitioners submitted that the petitioners are innocent of the offence alleged against them. On the other hand, learned Additional Public Prosecutor submitted that the allegations are serious in nature and it is not a fit case to grant bail to the petitioners.

Considering the facts and circumstances of the case and in view of the seriousness of the allegations levelled against the petitioners, this Court is not inclined to grant anticipatory bail to the petitioners at this stage.

Accordingly, the Criminal Petition is dismissed.
