THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL PETITION No.14362 OF 2015 ORDER:
1 This petition is filed under Section 482 Cr.P.C to quash the proceedings against the petitioner/accused No.5 in C.C.No.452 of 2014 on the file of the Court of the Additional Judicial First Class Magistrate, Huzurabad.
2 At the time of arguments, the learned counsel for the petitioner has sought permission of the Court to permit the petitioner to withdraw this Criminal Petition, with liberty to avail the remedies available to her under law, including filing of petition for discharge before the trial Court if charges are not already framed. He further requested that the presence of the petitioner / A.5 before the trial Court may be dispensed with on each and every date of adjournment.
There is no dispute with the regard to the identity of the petitioner, who is accused No.5 in the case. Even if the presence of the petitioner/A.5 is dispensed with, no prejudice will be caused to the 2nd respondent.
4 In the result, the Criminal petition is dismissed, granting the liberty as prayed for. The presence of the petitioner who is accused No.5 in C.C.No.452 of 2014 on the file of the Court of the Additional Judicial First Class Magistrate, Huzurabad is dispensed with on each and every dated of adjournment. However, she shall appear before the trial Court as and when her presence is so required. As a sequel, the miscellaneous petitions, pending if any in this Criminal Petition, shall stand closed. __________________________
