THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 17100 OF 2006 O R D E R:

This Writ Petition has been filed to declare the action of the respondent District Collector in proposing to acquire the land admeasuring Acs.4.00 in Survey No. 48/1 situated at Manopad Village and Mandal, Mahabubnagar District, as per notification issued under Section 4(1) of the Land Acquisition Act, 1894 (for short, 'the Act') dated 06.06.2006, as illegal and arbitrary. The respondent has not filed any counter-affidavit. However, today, learned Government Pleader for Land Acquisition has placed on record the proceedings of the Collector & District Magistrate, Mahabubnagar, dated 05.02.2007 and the Special Supplement to The Mahabubnagar District Gazette, dated 12.02.2007, whereby the draft notification issued under Section 4(1) and draft declaration under Section 6 of the Act, in respect of the land in an extent of Acs.8.00 situated in Survey Nos. 48/1 and 48/2 of Manopad Village and Mandal were withdrawn under Section 48(1) of the Act. The same are taken on record.

In view of the above, the Writ Petition stands closed. No costs.

Consequently, the interim order dated 18.08.2006 passed by this Court in W.P.M.P.No. 21444 of 2006 shall automatically stand dissolved.
