THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.38089 of 2012 ORDER:
Heard Sri Challa Gunaranjan for petitioner, Sri Srinivas Rao for 1st respondent and Sri M.Ravindra for respondents 2 to 4. The petitioner admittedly is an HT consumer of 2nd respondent. The subject matter of the writ petition relates to consumption charges/penalty levied by respondents 3 and 4 for the months of September, October and November, 2012. Counsel appearing for the parties submit that A.P. Electricity Regulatory Commission issued proceedings No.APERC/SECY/154/2013 dated 08-08-2013 dealing with partial waiver of penal charges levied as per the restrictions and control measures implemented by respondents during the subject period, according to which, the bills issued by respondents 3 and 4 are required to be revised and appropriate and exact bill is raised by respondents 3 and 4.
The standing counsel submits that if the petitioner represents against the afore-stated bills, the respondents will consider in terms of order of Electricity Regulatory Commission, dated 08-08-2013 and the amount payable by the petitioner is determined and communicated to petitioner.
The statement of the standing counsel is placed on record. The petitioner is given liberty to raise available objections against the afore-stated bills within four weeks from today by enclosing a copy of this order and respondents 3 and 4 are
directed to take appropriate decision and communicate to petitioner.
Till the decision is taken and communicated to petitioner, the service connection of petitioner for non-payment of amount due and payable under the afore-stated bills is not disconnected.
The writ petition is, accordingly, disposed of. There shall be no order as to costs.
Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
