THE HONOURABLE Dr.JUSTICE B.SIVA SANKARA RAO Criminal Petition No.7535 of 2017 ORDER :

Heard the learned counsel for the petitioner/ A.2 in Cr.No.44 of 2017 of P.S.Ramachandrapuram, Chittoor District, registered for the offence punishable u/ sec.34(A) of A.P.Excise Act, outcome of the complaint of the 2nd respondent/ Defacto-complainant and also the learned Public Prosecutor for the 1st respondent-State and perused the grounds urged in quash petition and First Information Report and also the expression placed reliance by the learned counsel for the petitioner in Remedi Srinivas Reddy vs.State of Andhra Pradesh1 of the learned Single Judge of this Court. In the above expression, the facts are outcome of false final report in quashing the proceedings against the A.3 and A.4 but the present crime is still at nasal stage and registered on 30.03.2017. Having regard to the above, this Court cannot apply that ratio interdicting the investigation but for to say pending investigation, the petitioner shall not be arrested. Further remedies are left open.

Accordingly, the Criminal Petition is disposed of.

Consequently, Pending miscellaneous petitions, if any, shall stand closed.
