THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.43241 of 2016 ORDER:

In this writ petition, the petitioner seeks a writ of mandamus declaring the charge sheet filed by the 2nd respondent in C.C.No.385 of 2015 on the file of XX Metropolitan Magistrate, Cyberabad at Malkajgiri as arbitrary and illegal.

The main grievance of the petitioner is that on the complaint given by the 3rd respondent, the 2nd respondent registered a case in Crime No.78 of 2015 on 19.3.2015 and though there is no allegation as against the petitioner herein, the 2nd respondent without verifying the records, laid the charge sheet as against the petitioner along with A.1 in the said crime. However, after arguing for sometime, the learned counsel for the petitioner confined his argument to the extent of dispensing with the presence of the petitioner before the trial Court. This Court is not inclined to interfere with the impugned proceedings. But however, since the petitioner is a medical officer and a lady, this Court is inclined to dispense with her presence before the trial Court.

In the circumstances, the presence of the petitioner before the trial Court is dispensed with except on the dates so specifically the trial Court insists for her appearance.

Accordingly, the writ petition is disposed of. No order as to costs. Pending Miscellaneous Petitions, if any, shall stand closed. _________________ RAJA ELANGO,J 14.12.2016.
