HON'BLE SRI JUSTICE S.V. BHATT Writ Petition No.20938 of 2017 ORDER:

The petitioner claims to be in possession of a portion of land in Sy.No.266 of Kamkole village, Munipally Mandal of Sangareddy District. Now the complaint is in spite of existence of house patta granted on 21.06.2005, 2nd respondent is interfering with petitioner's possession and enjoyment. Hence, the writ petition.

2. At request of 2nd respondent, the matter was directed to be taken up today. The Assistant Government Pleader on instructions submits that the patta relied upon by petitioner is not genuine and the grant is not recorded in the records maintained by 2nd respondent.

3. After perusing the material available on record, this court is of the view that possession of petitioner in whatever manner and which ever way is not disputed by 2nd respondent. Therefore, the 2nd respondent, if intends to seek dispossession or eviction of petitioner from subject matter of the writ petition, the same shall be in accordance with law. At that time, the petitioner is given liberty to rely upon all the documents on which the petitioner claims legal possession and it is for 2nd respondent to consider and pass orders.

4. The writ petition is disposed of accordingly. No order as to costs. Pending miscellaneous petitions if any in this writ petition shall stand dismissed in consequence.
