THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION NO.15470 OF 2015 ORDER:

Heard the learned counsel for the petitioner and the learned Government Pleader for the respondents.

The petitioner is a Fair Price Shop Dealer in respect of Shop No.24 of Enumuladoddi Village, Kundurpi Mandal, Anantapur District.

On the basis of the report submitted by the Tahsildar, Kundurpi Mandal, dated 25.04.2015, the third respondent issued an order of suspension of authorization of the petitioner by order dated 02.05.2015. Challenging the said order, the present Writ Petition is filed.

Learned counsel for the petitioner submitted that the Fair Price Shop of the petitioner was not inspected and no report was submitted by the Tahsildar.

When this Court called for record, learned Government Pleader produced the record and submitted that on the panchanama, the petitioner himself has signed. But the learned counsel for the petitioner submits that the signature on the panchanama is not that of the petitioner.

However, in view of suspension of authorization for a period of 90 days, as can be seen from the order dated 02.05.2015, this Court is not inclined to interfere with the said order at this stage but directs the third respondent to complete the enquiry by issuing an appropriate show cause notice, inviting reply from the petitioner and conducting an enquiry.

The Writ Petition is, accordingly, disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, pending shall stand closed.
