THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.13475 of 2017 ORDER:

This Writ Petition is filed challenging registration of FIR No.32 of 2017 by the second respondent pursuant to the complaint lodged by the third respondent.

Though the learned Counsel for the petitioner tried to impress upon this Court that the sections under which the crime was registered was not applicable, this Court is not inclined to entertain such plea at this stage, since the investigation is taken up by the second respondent. In view of the above, this Writ Petition is disposed of directing the second respondent to follow due process of law, including compliance with Section 41-A of the Code of Criminal Procedure. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs.
