HON'BLE SRI JUSTICE S. RAVI KUMAR Tr.CIVIL MISCELLANEOUS PETITION No.556 of 2015 ORDER:
This petition is filed to withdraw O.P.No.1798 of 2014 from the file of Additional Family Court, Hyderabad and transfer the same to Family Court, Eluru, West Godavari District.
2. Wife filed this petition. According to her affidavit, respondent had ill-treated her and her child and due to the illtreatment, she left the marital home and thereafter she filed MC No.1 of 2015 before II Additional Judicial First Class Magistrate, Eluru, West Godavari and also filed DVC No.10 of 2015 before Special Mobile Judicial First Class Magistrate, Eluru and both the cases are pending and she and her son are temporarily residing at her father's house and they are not in a position to eakeout their livelihood. She also stated that respondent filed O.P.No.1798 of 2014 before Additional Family Court, Hyderabad for dissolution of marriage and stated that it is difficult for her to travel from Eluru to Hyderabad, which is nearly 400 KMs and that she has a life threat in the hands of respondent at Hyderabad. For these reasons, she prayed for transfer of O.P.No.1798 of 2014 from Additional Family Court, Hyderabad to Family Court, Eluru, West Godavari District.
3. Respondent in spite of service of notice neither appeared in person nor through any advocate.
4. Heard advocate for petitioner.
5. Considering the reasons stated in the affidavit and also considering the convenience of wife, O.P.No.1798 of 2014 is withdrawn from the file of Additional Family Court, Hyderabad and transferred to Family Court, Eluru, West Godavari District for
disposal in accordance with law.
6. Accordingly, the Transfer Civil Miscellaneous Petition is ordered. No costs. Miscellaneous Petitions, if any pending, in this petition, shall stand closed.
