HON'BLE SRI JUSTICE R. KANTHA RAO Writ Petition No.11317 of 2015 ORDER:

Heard the learned counsel appearing for the petitioner and the Government Pleader for Civil Supplies for the State of Andhra Pradesh.

2. This writ petition is filed seeking writ of Mandamus declaring the action of the respondents in suspending the authorization of the petitioner to F.P. shop No.21 of Kondalacheruvu Village, Narayanavanam Mandal, Chittoor District, as illegal and arbitrary.

3. The Fair Price shop of the petitioner was inspected by the authorities on 07.03.2015 and certain variations have been noticed in the stock, apart from other irregularities. Basing on the report of the 4th respondent-Tahsildar, Narayanavanam Mandal, the 3rd respondent passed impugned orders suspending the authorisation of the petitioner.

4. As the variations noticed during the course of inspection are beyond permissible limits, this Court is not inclined to go into merits of the suspension of the authorisation and a detailed enquiry has to be conducted against the petitioner. Therefore, the 3rd respondent-Revenue Divisional Officer, Chittoor, is directed to conduct enquiry against the petitioner and pass final orders within a period of eight

(8) weeks from the date of receipt of a copy of this order.
