This court made the following :

THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.2761 of 2016 ORDER :

Petitioner is removed from service by proceedings dated 17.12.2015 on the

allegation of misrepresentation and production of false documents in support of the claim for compassionate appointment and date of birth. Aggrieved by the said order, petitioner claimed to have preferred an appeal to the appellate authority on 09.01.2016. Even before the ink is dried on the appeal filed by the petitioner, this writ petition is filed.

2. When the petitioner has an effective and efficacious remedy by way of appeal and the said remedy of appeal is already availed, this Court cannot go into the merits of the order impugned in the writ petition.

3. Thus, leaving it open to the petitioner to pursue the appeal, the writ petition is dismissed. It is needless to observe that the appellate authority shall consider and pass orders in appeal as expeditiously as possible. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand dismissed.
