THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.1980 OF 2016 ORDER:

This Criminal Petition is filed under Section 482 of Code of Criminal Procedure (Cr.P.C) by the petitioners/accused Nos.1 and 2 seeking to quash the F.I.R.No.304 of 2015 of Ramgopalpet Police Station, Secunderabad, registered for the offence under Section 304-A I.P.C.

Heard the learned counsel for the petitioners/accused Nos.1 and 2 and the learned Public Prosecutor and perused the material available on record.

The learned counsel for the petitioners submits that the petitioners/accused Nos.1 and 2 are apprehending arrest in view of the pendency of the above crime.

Having regard to the facts and circumstances of the case and also in view of the nature of offence alleged against the petitioners, this Court is not inclined to interfere with the proceedings against the petitioners/accused Nos.1 and 2.

However, the Respondent-Police are directed to

investigate the matter in accordance with the guidelines rendered by the Apex Court in Jacob Mathew v. State of Punjab and another[1] and to file final report, if any, without arresting the petitioners. The petitioners/accused Nos.1 and 2 are directed to appear before the Investigating Agency as and when their presence is required, and cooperate with the Investigating Agency.

With the above direction, the Criminal Petition is disposed of. Consequently, miscellaneous petitions, if any, pending, shall stand closed.
