THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.2990 OF 2017 ORDER:
This writ petition is filed challenging the action of the respondents 6 and 7 in harassing the petitioners in an unjustified manner and direct the respondents 2 to 4 to consider the representation, dated 08.12.2016. In view of the nature of allegations against the respondents 6 and 7, this Court called for a counter affidavit and the third respondent filed a counter affidavit stating that the first petitioner is the first accused along with second petitioner, who is her husband, in crime No.137 of 2016, which was registered basing on the complaint lodged by one Shalini Bai. A charge sheet was also filed on 29.11.2016 and the same is pending trial in C.C.No.387 of 2016 before the IV Additional District Judicial Magistrate of First Class, Chittoor. The representation made by the first petitioner on 08.12.
2016 making certain allegations against the respondents 6 and 7 was received and the matter was entrusted to Sub Divisional Police Officer, Chittoor, for enquiry and report. He made an enquiry and submitted a report on 05.01.2017 and it reveals that the first petitioner bore grudge against Chittoor II Town Police Station, Chittoor, particularly against the Inspector of Police and Station House Officer, Chittoor II Town Police Station, Chittoor, for registration of crime Nos.94 of 2016 and 137 of 2016 against the first petitioner and her family members and for filing charge sheet in crime No.137 of 2016. The allegations against the respondents 6 and 7 were found to be baseless. In view of the said averments, the relief sought by the petitioners cannot be accepted.
However, this order will not prevent the petitioners from submitting a representation to the respondents 2 and 3 when there is any harassment by the respondents 6 and 7.
The writ petition is accordingly dismissed. Miscellaneous petitions, if any, pending in the writ petition shall stand closed. __________________________ A.RAMALINGESWARA RAO, J 10.04.2017 pln
