THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.19368 OF 2014 ORDER:

This writ petition is filed seeking to issue a writ or order more particularly, one in the nature of writ of mandamus to declare the action of the respondents in not allotting the essential commodities to petitioners' Fair Price Shops and trying to terminate their dealerships situated at Parakuvandla Palli Village and Tanakal Village of Anantapur District without assailing any reasons and without issuing any notice as illegal and arbitrary and consequently, to direct the respondents to release the essential commodities to the said Fair Price Shops till the permanent dealers are appointed.

Heard and perused the material available on record. 3.

On 11.7.2014, this Court, while admitting the writ petition, passed an interim order in W.P.M.P.No.24253 of 2014 as follows: "The case of the petitioner is that though he is having valid and subsisting fair price shop authorization, the respondents are not supplying stocks to his fair price shop. Aggrieved by the same, he filed the present writ petition.

In view of the above, there shall be direction to the respondents to supply the essential commodities to the petitioner's fair price shop, as long as his authorization is valid and subsisting or till permanent appointment is made by the respondents, whichever is earlier. However, this order will not preclude the competent authority from taking action against the petitioner, in case if the petitioner commits any violations. It is also open for the competent authority to make permanent appointments"

Considering all the facts and circumstances of the case, this Court is of the view that the said interim order can be made absolute and the same is, accordingly, made absolute and the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
