HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.16725 of 2019 ORDER:

The only grievance of the petitioner is that the 3rd respondent is not taking any action on the representation made by him on 24-07-2019 seeking to disqualify the 4th respondent who was elected as MPTC of Thakkallapally, Rebbena Mandal, KB Asifabad District on the ground that he has suppressed the fact that he is having three children at the time of filing election nomination for the post of MPTC of Thakkallapally in the election conducted in the month of May, 2019. Aggrieved by the same, the present writ petition is filed.

Sri G.Narender Reddy, learned Standing Counsel for respondents 1 to 3 submits that though the ground on which the petitioner is seeking disqualification of the 4th respondent, he has to approach the MPDO by making application to that effect. But without making such application, straightaway he filed the present writ petition.

On the other hand, learned counsel for the petitioner submits that the petitioner has made representation to the Revenue Divisional Officer but however he does not dispute the fact that MPDO is the competent authority to deal with similar complaints under Section 27 read with Section 151 of Telangana Panchayat Raj Act, 2018.

In view of the same, the writ petition is disposed of granting liberty to the petitioner to approach the MPDO in respect of his grievance as stated supra and the concerned MPDO has to take appropriate action on the application of the petitioner under

Section 27 read with Section 151 of Telangana Panchayat Raj Act, 2018, in accordance with law.

As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY,J 06-08-2019 Nvl
