THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION NO.18162 OF 2015 ORDER:
Heard the learned counsel for the petitioner and the learned Government Pleader for Co-operation for the respondents. The petitioner is a member of the fourth respondentSociety. Elections are scheduled to be held to the fourth respondent-Society on 28.06.2015.
The only grievance of the writ petitioner is that the Election Officer-the fifth respondent herein has been taking assistance of the employees who are working on contract basis since last four elections and it was noticed that they have been canvassing in favour of a particular person. A request was made to the fifth respondent on 09.06.2015 not to allot such persons, who are biased, in the elections to be held on 28.06.2015. When no action was taken on the said request, the present Writ Petition is filed. It is needless to state that the elections have to be conducted in a free and fair manner. In view of the allegation against some employees, who are allotted on election duty, it is the responsibility of the fifth respondent to take the assistance of the persons, who do not vitiate the election process. In the circumstances, the fifth respondent is directed to consider the representation dated 09.06.2015 and take assistance of the persons, who work in an unbiased manner and conduct elections in a free and fair manner.
The Writ Petition is, accordingly, disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, pending shall stand closed.
