HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.36098 of 2016 ORDER:

Heard learned counsel for the petitioners, learned Standing Counsel for Municipality, learned Government Pleader for Irrigation and learned Government Pleader for Revenue. With the consent of both the parties, the writ petition is taken up for disposal at the admission stage itself.

The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of respondent Nos.2 to 6 in proposing to demolish and dispossess the petitioners from the peaceful possession and enjoyment over the property i.e.House No.13-46(Plot No.46, constructed in the land admeasuring 165 square yards) of the first petitioner and house bearing No.13-45 (constructed in plot No.45 in the land admeasuring 178 square yards) belonging to second and third petitioners and H.No.1331(Plot No.31 constructed in the land admeasuring 209 sq.yards) of the fourth petitioner, situated at Sri Sri Nagar, Bibi Saheb Maktha village, Peerzadiguda Municipality, Medipally Mandal, Medchal District, as illegal and arbitrary.

The grievance of the petitioners appears to be that they apprehend dispossession from the lands in question, without following due process of law.

Learned Standing Counsel for respondent Nos.5 and 6 and learned Government Pleader for Irrigation would submit that any action done by the authorities will only be in accordance with law.

Recording the above submission, the present writ petition is disposed of directing the respondents not to dispossess or demolish the structures raised in the land in question, without following due process of law. No order as to costs. 6.

Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
