THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI Writ Petition No.17454 of 2010 ORDER:
This writ petition is filed seeking the following reliefs: 'To issue a Writ, order or direction, one in the nature of Writ of Mandamus declaring the action of the respondents in not permitting the students of the petitioner Institute Electrician 2 units additional and new trade Refrigeration & Air Conditioning 1 units (2008-10 batch) for All India Trade Test to be held from 23.07.2010 as irregular, illegal and further direct the respondents to pass permanent affiliation orders on the basis of the Standing Committee Inspection Report, supplementary Inspection report and 1st respondent's recommendation and any latest Standing Committee report of 2010 and also direct the respondents to issue National Trade Certificates to the students by declaring the results and to pass such other order or orders.'
[Reproduced verbatim] When the matter, which is listed under the caption 'for orders', is taken up for hearing, there is no representation for both the sides. I have perused the material record.
This Court on 21.07.2010 while admitting the writ petition had granted interim directions as prayed for; but had, however, further directed that the results shall not be published until further orders. Subsequently, on 19.01.2011, the learned counsel for the respondents sought time to file counter. Therefore, while directing the matter to be listed on 15.02.2011 this Court had passed the following order: 'In the meanwhile, directions are issued to the respondents to announce the results of the students of the petitioner's institute in respect of the examinations they have appeared in the month of July 2010 forthwith'. In view of the relief claimed in this writ petition and the subsequent orders of this Court, this Court is of the considered view that nothing survives for adjudication in the writ petition and that, therefore, the writ petition is liable to be dismissed as infructuous. Accordingly, the Writ Petition is dismissed as infructuous. There
shall be no order as to costs.
Miscellaneous petitions pending, if any, in this writ petition shall stand closed.
