HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI CONTEMPT CASE No.1082 of 2019 ORDER:
When the matter is taken up for hearing, the learned Government Pleader appearing for the respondents submits that pursuant to the order of this Court, the case of the petitioner was considered and rejected vide proceedings dated 08.09.2019. Learned counsel appearing for the petitioner submits that the order passed by this Court has been received by the respondents on 06.07.2019 and the respondents have passed the rejection order after expiry of four weeks time stipulated by this Court and the respondents are liable for contempt and the respondents be punished accordingly.
From a perusal of the material available on record, no where it is stated that as to when the copy of the order of this Court was served on the respondents. Even if the order copy is served on the respondents on 06.07.2019 as contended by the learned counsel for the petitioner, the respondents have passed the order on 08.09.2019 with a delay of one month and two days and the said act will not amount to wilful disobedience in order to take action under the Contempt of Courts Act. Moreover, the respondents have considered the case of the petitioner and rejected vide proceedings dated 08.09.2019.
Therefore, the Contempt Case is closed. If the petitioner is aggrieved by the rejection order dated 08.09.2019, he is at liberty to challenge the same.
