HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO Writ Petition No. 18027 of 2016 Order:
The petitioner claims that he is working as Pharmacist Grade-II in the second respondent-Corporation and he was deputed to work at Central Medicine Stores in the Head Office, Hyderabad, vide orders dated 04.12.2013. The posting orders were issued on 01.01.2014 and, accordingly, he joined in the said office. He states that he was orally told that the said deputation was for a period of five years and on the basis of such representation he shifted his residence from Nalgonda to Hyderabad city and admitted his children in the Educational Institutions. When the orders dated 03.11.2015 were passed repatriating him to the parent department, the present Writ Petition is filed. He states that the post of Pharmacist Grade-II at Primary Health Centre, Bollepally in Nalgonda District is filled up and there is no vacancy. His wife is suffering from psychiatric disorder and taking treatment under a Doctor in Hyderabad.
2. The order of repatriation reads as follows. "Sri Md. Mutaher Mohiuddin, Pharmacist Gr-II (DPH & FW) working on deputation with TSMSIDC Drugs Wing, Head Office, Hyderabad, is hereby repatriated to his parent department immediately, pending completion of enquiry against him and on administrative grounds. He is directed to handover the complete charge of the post held by him to Sri R. Suresh Pharmacist Gr-II. He is also directed to hand over the SIM Card and Identity Card in the administration wing.
Sri R. Suresh Pharmacist Gr-II is directed to take over the complete charge of the post held by Sri Md. Mutaher Mohiuddin, Pharmacist Gr-II and look after the works until further orders."
3. Since it is an order of repatriation to the parent department and more so when an enquiry is pending against the petitioner, this Court is not inclined to interfere with the orders of repatriation.
4. The Writ Petition is, accordingly, dismissed. There shall be no order as to costs.
5. As a sequel thereto, the miscellaneous applications, if any, pending in this Writ Petition shall stand closed. ________________________ A.
