THE HONOURABLE SRI JUSTICE M.S.RAMACHANDRA RAO WRIT PETITION No.36530 OF 2015 O R D E R :

Heard counsel for the petitioner and Government Pleader for Cooperation for respondents 1 to 7 and Sri N.Jayasurya, counsel for 8th respondent.

2. Although, petitioner has questioned the proceedings dt.28.10.2015 of the 3rd respondent and the consequential proceedings dt.02.11.2015 of the 7th respondent proposing to conduct elections for the post of Chairman to the 6th respondent-Bank, since admittedly there is a vacancy caused by the death of the existing incumbent, no objection can be taken to the conduct of elections to the post of Chairman to the 6th respondent-Bank.

3. However, petitioner has alleged that respondents 8 to 10, who are directors of the 6th respondent-Bank, may not be allowed to contest the said elections in view of certain allegations leveled against them in respect of which he has given representation dt.23.04.2015 and 03.10.2015 to respondents 3 to 5.

4. Having regard to the above, this Writ Petition is disposed of directing the 5th respondent to dispose of the representations dt.23.04.2015 and 03.10.2015 submitted by the petitioner within a period of four (04) weeks from the date of receipt of a copy of this order. There shall be no order as to costs.

5. Consequently, Miscellaneous Petitions pending if any, shall stand

closed.
