HON'BLE SRI JUSTICE M. SATYANARAYANA MURTHY A.S.M.P.No.1288 of 2015 AND APPEAL SUIT No.156 of 2012 ORDER :

The petitioners filed A.S.M.P.No.1288 of 2015 seeking leave to withdraw the appeal with liberty to seek appropriate relief before appropriate Court or Authority, stating that the suit was dismissed at the stage of passing final decree with an observation that the petitioners have to approach the Civil Court for appropriate relief.

2. In view of the finding of the Court below, the petitioners intend to approach the Civil Court for appropriate relief. Hence, the petitioners are permitted to withdraw the appeal giving liberty as prayed for.

3. In the result, A.S.M.P.No.1288 of 2015 is allowed. Consequently, the appeal is dismissed as withdraw giving liberty to the appellants to redress their remedy before a competent Civil Court. No order as to costs.

4. Miscellaneous Petitions pending, if any, shall stand closed.
