THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No.1995 OF 2016 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for Revenue.

The petitioner is aggrieved by the notice, dated 02.01.2016, issued by the Tahsildar, Obulavaripalli Mandal, YSR Kadapa District, the 5th respondent herein, which refers to the pendency of the revision petition filed by her before the Joint Collector, YSR Kadapa District, the 3rd respondent. Earlier, the Sub-Collector, Rajampet Division, YSR Kadapa District, the 4th respondent, vide orders in LRDT/209/2011, dated 17.10.2013, held that the pattadar pass books issued to the petitioner and the 7th respondent are not justified and directed the 5th respondent to inspect the lands and resume the same to the Government for future needs. Aggrieved thereby, the petitioner preferred a revision petition before the 3rd respondent on 19.03.2015 and also moved a stay petition therein vide S.R.No.3058, dated 30.12.

2015, requesting for grant of stay of order, dated 17.10.2013, of the 4th respondent, pending the revision petition. The petitioner states that as no orders are passed in the said revision petition as well as in the stay petition by the 3rd respondent, the impugned notice now issued by the 5th respondent would likely result in her dispossession and therefore seeks intervention of this Court.

Evidently, the petitioner's revision and the stay petition, as

referred to above, are pending with the 3rd respondent. Hence, in the interests of justice, it is appropriate to direct the 3rd respondent to fix an early date for hearing the revision petition as well as the stay petition preferably within a period of one week from the date of receipt of a copy of this order, after notice to the petitioner, and pass appropriate orders atleast in the stay petition on priority basis. Still appropriate orders, as directed above, are passed by the 3rd respondent, status quo as on today shall be maintained by the parties. The Writ Petition is accordingly disposed of. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
