HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION No.4806 of 2018 ORDER:

This Criminal Petition is filed under Sections 437 and 439 Cr.P.C to enlarge the petitioners/A10 and A12, who is in judicial custody since 13.07.2017, on bail in Crime No. 141 of 2017 of S.Kota Police Station, Vizianagaram District, registered for the offence punishable under Sections 8(c) read with 20(b)(ii) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short 'the NDPS Act').

Learned counsel for the petitioners contended that the petitioners filed petition under Section 167(2) Cr.P.C before the Court below and the same is pending for adjudication and requested the Court to direct the Court below to dispose the said application in accordance with law immediately.

Learned counsel for the respondent did not oppose to issue a direction to the Court below concerned to dispose of the petition under Section 167(2) Cr.P.C. in accordance with law. In view of pendency of petition under Section 167(2) Cr.P.C., I deem it appropriate to direct the Court below concern to dispose of the same in accordance with law, in any event not later than 10 days from today.

With the above direction, the criminal petition is disposed of without touching the merits of the case.

Pending miscellaneous petitions in the petition, if any, shall stand closed.
