THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No. 16719 of 2006 ORDER:

It is the case of the petitioner that Medipally Primary Agricultural Cooperative Credit Society Limited is having 13 Members, who were elected on 26.10.2005. The petitioner was elected as Member from Constituency No.5 and respondent No.4 was elected as Members from Constituency No.9. On 28.10.2005, respondent No.3 conducted elections for the post of President and Vice President and 7 Members have voted in favour of the petitioner and he was declared elected as President. Challenging the election of the petitioner, respondent No.4 filed O.P.No.54 of 2005 before A.P. Cooperative Tribunal, Warangal-respondent No.1. The election of the petitioner was set aside by order, dated 28.07.2006. Challenging the same, the present writ petition was filed. This Court by order, dated 09.08.2016, granted interim suspension and the said order has been in operation till today. However, by afflux of time, the cause of action in the writ petition does not survive as the period of five years was completed long back.

The writ petition is accordingly dismissed as infructuous. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs. ________________________ A.RAMALINGESWARA RAO,J Dt:18.10.2016 kdl
