Peddiraju Rukmini v. The State Of Telangana,
THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION NO.14288 OF 2018 Dated 24th April 2018 Between:
Peddiraju Rukmini, W/o Peddiraju.
...Petitioner
And
1. The State of Telangana, rep.by its Principal Secretary, Revenue Department, Secretariat, Hyderabad and five others.
...Respondents
The Court made the following:
THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION NO.14288 OF 2018 ORDER:
1.
Heard learned counsel for the petitioner and learned Government Pleader for Revenue appearing for the respondents. 2.
Petitioner claims to be the owner and in possession of land to an extent of Acs.4.20 gts situated at Theegalpahad Village, Nazpur Mandal, Mancherial District. She further claims to be in possession and enjoyment of the said property. Petitioner filed relevant documents reflecting her name in the revenue records as private patta land. This Writ Petition is filed alleging that respondent-authorities are trying to interfere with the peaceful possession and enjoyment of her land and alleges that respondents 2 to 6 along with staff visited their land on 05.03.2018 and tried to dispossess her.
3.
No reason is shown, why respondents would interfere, more so when the petitioner claims that land in issue is private patta land. As she claims to be in possession and enjoyment, the respondents-authorities cannot be expected to dispossess her without following due process of law. If the subject land is private patta and is required for any public purpose, the respondentauthorities should follow due process before dispossessing the petitioner. No such steps are taken, hence, the cause in the Writ Petition is premature.
4.
The Writ Petition is dismissed. There shall be no order as to costs. Miscellaneous petitions, if any, pending shall stand dismissed.
