THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.36830 OF 2016 ORDER:

The writ petition is filed by the petitioner seeking a writ of mandamus declaring the action of the fourth respondent in opening and continuing the rowdy sheet No.2 of 2000 against the petitioner as illegal and arbitrary, and consequently, to direct the respondents 3 and 4 to close the Rowdy Sheet against the petitioner.

Heard and perused the material.

Learned counsel for the petitioner submits that the petitioner was falsely implicated in two cases in 1999 and 2000 and subsequently, he was acquitted by the competent Court. He further submits that two bind over cases were also registered against the petitioner in 2012 and 2013. He further submits that on the direction of the third respondent, a rowdy sheet was opened against the petitioner by the fourth respondent. He further submits that though the petitioner is not involved in any other crimes, the respondents are continuing the rowdy sheet against the petitioner and as such, he prays this Court to direct the respondents 3 and 4 to close the rowdy sheet against the petitioner.

Considering the facts and circumstances of the case, the petitioner is directed to make a representation to the respondents 3 and 4 stating that he is not involved in any other crimes apart from the crimes mentioned above and on filing of such application, the respondents 3 and 4 are directed to consider the representation and pass appropriate orders. Further, the respondents 3 and 4 are directed not to compel the petitioner to attend before the Police Station. The writ petition is accordingly disposed of. Consequently, miscellaneous petitions, if any shall also stand disposed of. _____________________ JUSTICE RAJA ELANGO 22.11.
