HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.16675 of 2019 ORDER:

Though this writ petition is filed to declare that the 1st respondent does not belong to Koya community and not competent to hold the post of President, Mandal Praja Parishad, Bayyaram and to issue an order or writ particularly in the nature of writ of Mandamus restraining the 2nd respondent from administering the oath of office to the 1st respondent as President, Mandal Praja Parishad, Bayyaram on 06-08-2019, learned counsel for the petitioner submits that as the matter could not be taken-up on 05-08-2019 already oath of the 1st respondent has taken place today. He also submits that the petitioner has already filed election petition and the same is pending before the Election Tribunal challenging the election of the 1st respondent on the ground that she does not belong to Scheduled Tribe (S.T.)

community, though elected in the vacancy belong to S.T. community. But the same is not being disposed of. In view of the same, learned counsel for the petitioner submits that the writ petition may be disposed of directing the Election Tribunal to dispose of the election petition as expeditiously as possible.

Since it is stated that election petition is pending before the Election Tribunal, the Election Tribunal i.e. the Revenue Divisional Officer, Mahabubabad, is directed to dispose of the election

petition as expeditiously as possible preferably within a period of six months from the date of receipt of a copy of this order. Accordingly, the writ petition is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
