Heard.

Petitioner complains of refusal by the second respondent to receive, register and release the document with respect to petitioner's house property bearing Door No.3-5 in Sy.No.142/2A situated at Kattunga Village, Atreyapuram Mandal, East Godavari District, on the ground that the land is a gramakantam land in the prohibitory list.

Since the petitioner seeks registration of relinquishment deed, which was executed on 25-05-2013, he is at liberty to present the document before the 2nd respondent to examine the same in accordance with the Registration Act, 1908 (for short 'the Act') and Indian Stamp Act, 1899. The 2nd respondent is free to examine the document and if he is satisfied, process and register the same. In the event the 2nd respondent is of the opinion that the document warrants refusal of registration, he shall pass appropriate orders duly recording the reasons for such refusal in accordance with Section 71 of the Act.

Accordingly, the writ petition is disposed of. No order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
