HON'BLE JUSTICE G. SRI DEVI CRIMINAL PETITION No.4674 of 2019 O R D E R :
This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973 is filed by the petitioner, who is Accused, for grant of anticipatory bail in the event of his arrest in Crime No.280 of 2019 of SHO, Godavarikhani I Town Police Station, Ramagundam Mandal, Peddapalli District, registered for the offences punishable under Sections 420 and 506 of IPC.
The case of the prosecution is that the complainant and others have lodged a complaint stating that the petitioner/Accused induced them on a false promise that he is working as a Police Constable and he would arrange a Scavenger job in Singareni Area Hospital, Godavarikhani, and on such false promise, he obtained huge amounts from them and on his failure to provide a job, when they asked to return the amount, the accused threatened them with dire consequences and thereby cheated them.
Heard learned counsel for the petitioner/Accused and the learned Additional Public Prosecutor appearing for the respondent State. Perused the material on record. Learned counsel for the petitioner contends that the sister and brother-in-law of the petitioner have borrowed an amount of Rs.3,95,000/- from the complainant and others by
executing promissory notes in their favour and the amount was deposited in the account of the sister of the petitioner. It is also contended that as the sister and brother-in-law of the petitioner failed to repay the said amount, to pressurize them, the complainant has filed the present false case against the petitioner by influencing the police and converted the civil case into a criminal case. It is also contended that the petitioner is ready to abide by any conditions imposed by this Court, including assisting the investigating agency for his release on anticipatory bail in the event of his arrest in the above crime.
On the other hand, the learned Additional Public Prosecutor opposed the relief sought in the above petition. As seen from the contents of FIR, there are specific allegations against the petitioner that he collected huge amounts from the complainant and others on a false promise of providing Scavenger job in Singareni Area Hospital, but failed to provide the same and when they demanded to return the said amount, the petitioner has not returned the same. Thus, in view of the specific allegations levelled against the petitioner, I am not inclined to grant anticipatory bail to the petitioner. However, if the petitioner/Accused surrenders before the Court below concerned and moves an application for regular bail, after giving prior notice to the Public Prosecutor concerned, the said application shall be considered in accordance with law.
With the above observations, this Criminal Petition is dismissed.
As a sequel, miscellaneous petitions pending, if any, shall stand closed.
