THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.4293 of 2022 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Criminal Procedure Code by the petitioner/A1 in Crime No.26 of 2022 of Nizamabad VI TN Police Station, Nizamabad, registered for the offences punishable under Sections 147, 307 read with 149 of the Indian Penal Code.

The case of the prosecution is that on 15.02.2022, A1, A2 and A5 were at New Bridge, Autonagar, Nizamabad, and having seen LWs.1 and 2, altercation ensued. Thereafter, the petitioner who is Accused No.1 and other accused formed into an unlawful assembly and attacked LWs.1 and 2. The police having completed investigation filed charge sheet. The accused Nos.2 to 9 were already released on bail.

Learned Assistant Public Prosecutor submits that the present petitioner is also involved in other cases. 4.

However, keeping in view the injuries received by LWs.1 and 2 are simple in nature, according to the charge sheet, this Court is of the opinion that bail shall be granted to this petitioner also. 5.

Accordingly, the petitioner/A1 is directed to be released on bail on the following conditions.

i. the petitioner/A1 is directed to be released on bail on his executing personal bond for Rs.25,000/- (Rupees

Twenty Five Thousand only) with two sureties each for a likesum, to the satisfaction of the II Additional Judicial First Class Magistrate, Nizamabad.

ii. After release on bail, the petitioner/A1 shall appear before the Investigating Officer on every date of hearing between 10.00 a.m to 5.00 p.m., for a period of three months or till filing of the charge sheet whichever is earlier.

iii. The petitioner/A1 shall not indulge in any activity attracting penal consequences, failing which the police are at liberty to file petition seeking cancellation of bail. iv. The petitioner/A1 shall comply with the conditions as laid down under Section 437 (3) of Cr.P.C.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, if any, pending shall stand closed.
