This appeal is filed by the defendant No.1, under Section 100 of CPC, assailing the decree and judgment dated 18.9.1999 passed in A.S.No.2 of 1995 on the file of the Court of the Senior Civil Judge, Yellamanchili.

At the time of hearing, learned counsel for the appellant submitted that he has no instructions from the appellant. In view of the submission made by the learned counsel for appellant, no purpose will be served by keeping the matter pending. 3.

Accordingly, the second appeal is dismissed for nonprosecution. Miscellaneous Petitions, if any, pending in this appeal shall stand closed.
