The Hon'ble Sri Justice A.V.Sesha Sai Writ Petition No.10742 of 2017 Date: 06.04.2017 Order:

Heard the learned Counsel for the petitioner, learned Government Pleader for Panchayat Raj (TS) appearing for respondents 1, 2, 5 and 6, and Mr.G.Narender Reddy, learned Standing Counsel for respondent No.4- Gram Panchayat. The only grievance of the petitioner in the present Writ Petition is non-conclusion of enquiry pursuant to the show cause notice bearing No.4474/2014-A2(Pts), dated 26-05-2016, issued by respondent No.2- District Collector. By way of the said show cause notice, respondent No.3 was asked to submit his explanation as to why action should not be taken against him under Sections 265 (1) and 249 (6) of the T.S.Panchayat Raj Act, 1994.

In the affidavit filed in support of the present Writ Petition, it is stated that in response to the said show cause notice, respondent No.3 submitted an explanation on 04.07.2016, denying the allegations.

Earlier the petitioner

AVSS, J W.P.No.10742 of 2017 Dt: 06.04.2017 herein along with certain others filed WP.No.31607 of 2015 before this Court and this Court, while issuing notice to the respondents therein, directed respondent No.2- District Collector to consider the representations stated to have been made by the petitioner herein. Obviously, pursuant to the said interim order, respondent No.2 has issued the impugned show cause notice.

Since the only grievance of the petitioner in the present Writ Petition is non-conclusion of enquiry pursuant to show cause notice, dated 26-05-2016, this Court deems it appropriate to direct respondent No.2 to finalise the enquiry initiated against respondent No.3, pursuant to the said show cause notice, within a period of six weeks from the date of receipt of this order after giving notice and opportunity of hearing to both the parties. Subject to the above direction, the Writ Petition is disposed of.

As a sequel to disposal of the Writ Petition, Miscellaneous Petitions, pending if any, stand disposed of as infructuous. _______________ (A.V.Sesha Sai, J) Dt: 6th April, 2017 lur
