Heard learned counsel for the petitioner and learned Assistant Government Pleader for Home, appearing for respondents 1 to 4.
Learned Assistant Government Pleader for Home produced written instructions stating that they have not received any complaint dated 24.06.2019 as alleged by the petitioner and that since there is no order from the Civil Court granting injunction, they cannot grant any police protection to the petitioner in respect of the subject property.
A perusal of the complaint filed by the learned counsel for the petitioner does not disclose that the same is acknowledged by the police and no material is placed before this Court to show that the complaint was served on the respondents-police as on today. Even according to the learned counsel for the petitioner, petitioner has not approached the Civil Court for grant of injunction. In the absence of the same, this Court cannot grant police protection to the property of the petitioner. In view of above facts and circumstances, I do not see any reason to entertain the Writ Petition. However, this Writ Petition is disposed of granting liberty to the petitioner to avail alternate remedies available to him under law, if his possession over the
subject property is being interfered with by the unofficial respondents.
There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
