THE HONOURABLE SRI JUSTICE RAJA ELANGO CRL.P.M.P.No.6618 of 2016 & CRIMINAL PETITION No.5680 of 2016 ORDER:
This Criminal Petition is filed by the sole accused under Section 482 of Criminal Procedure Code seeking to quash the proceedings in S.C.No.58 of 2016 pending on the file of VII Additional Sessions Judge, R.R.District at L.B.Nagar for the offence under Section 307 IPC. The allegation against the petitioner is that he tried to kill his own daughter in a drunken condition. Along with the main petition, the de facto complainant, who is the wife of the accused and mother of victim girl filed Crl.P.M.P.No.6618 of 2016 stating that the parties have entered into compromise and therefore, she prayed to quash the impugned proceedings in the S.C. Since the complainant is not the aggrieved person, this Court directed the victim girl to be present before the Court.
Today, the de facto complainant, accused and the victim girl are present before the Court. On enquiry, the victim girl informed that she is not interested in prosecuting the matter as the accused is her own father and prayed to quash the impugned proceedings allowing the compromise petition. A perusal of the affidavit filed in support of the petition goes to show that the matter was settled between the parties. In view of the amicable settlement of the dispute between the parties and in view of the nature of the proceedings, Crl.P.M.P.No.6618 of 2016 is ordered and the compromise is recorded. Consequent thereto, the Criminal Petition is allowed and the proceedings in S.C.No.58 of 2016 pending on the file of VII Additional Sessions Judge, R.R.District at L.B.Nagar are hereby quashed as against the petitioner herein.
Miscellaneous petitions, if any, filed in this petition shall stand closed. _________________ RAJA ELANGO,J 21.04.2016.
