HON'BLE SMT JUSTICE ANIS S.A.M.P. No.22 OF 2016 IN/AND SECOND APPEAL No.75 OF 2014 COMMON JUDGMENT:
Learned counsel for appellants and respondents are present. Appellant/2nd defendant and respondents 2 and 5 are present.
In pursuance of the orders dated 01.02.2016 and 01.03.2016 in S.A.M.P.Nos.158 of 2016 and 159 of 2016, permission was accorded to the respondent No.5 to represent the respondents 4 and 3 respectively.
Both parties filed a compromise petition to compromise the matter in S.A.No.75 of 2014. The terms of the compromise were read over to all the parties in Telugu. All the parties in the open Court agreed that they have entered into the compromise voluntarily and with free will and without any force from any quarter. On such examination, this Court is satisfied that the compromise was entered into by the parties with free will and consent, and therefore, the compromise can be recorded.
2. Accordingly, S.A.M.P. No.22 of 2016 is ordered in terms of the joint compromise memo. Consequently, the Second Appeal is disposed of in terms of the memorandum of compromise annexed to S.A.M.P.No.22 of 2016. The affidavit and the joint compromise memo filed in S.A.M.P.No.22 of 2016 shall form part of the judgment. It is needless to say that the compromise is only related to the subject-matter of the Second Appeal. There shall be no order as to costs.
3. Miscellaneous Petitions pending, if any, in this Second Appeal shall stand closed.
