HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.37774 of 2016 ORDER:

This writ petition is filed by the petitioners under Article 226 of the Constitution of India seeking to declare the action of the 2nd respondent in registering crime No.555 of 2016 against the petitioners, as illegal and arbitrary and consequently quash the same. Heard and perused the material available on record. The 3rd respondent lodged a complaint against the petitioners and A1, alleging that the husband of the 1st petitioner, who is A1, cheated her by taking an amount of Rs.6.00 lakhs and 241 grams of gold coins on the promise of providing a job in Steel Plant, Visakhapatnam and did not provide any job and did not return the amount, and when she questioned the same, they abused her in filthy language and threatened to kill her.

Learned counsel for the petitioners submits that the petitioners are no way concerned with the allegations made in the above crime and that all the allegations are against A1 only, and that the petitioners are ladies and that they are apprehending arrest in the ands of police, therefore, requested to set aside the proceedings in the above crime. The petitioners filed this writ petition challenging the investigation in the above crime. This Court is not inclined to interfere with the investigation. However, taking into consideration the facts and circumstances of the case and also the submissions of the learned counsel for the petitioners, this Court is of the view that the investigation can be completed without arresting the petitioners.

Accordingly, the 2nd respondent is directed to complete the investigation and file a final report in the above Crime, in accordance with law in either way, without arresting the petitioners. The petitioners are also directed to appear before the investigating officer as and when required and cooperate with the investigation. With the above directions, the Writ Petition is disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
