HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No. 22649 of 2015 ORDER:

Heard the learned counsel for the petitioner and the learned Government Pleader for Civil Supplies. The Writ Petition is being disposed of at the stage of admission with the consent of parties. The petitioner was appointed as a fair price shop dealer of shop No.19, Uravakonda Village and Mandal, Anantapur District. Her authorization is valid upto 31.03.2016. Based on the report of the Tahsildar, Uravakonda, dated 15.03.2015, a show cause notice was issued to the petitioner on 27.03.2015. The petitioner submitted her explanation on 07.04.2015. After submission of her explanation, the third respondent passed an order on 09.04.2015 suspending her authorization. Against the same, the petitioner preferred an appeal to the second respondent who disposed of the same on 22.05.2015 directing the third respondent to dispose of the main case pending before him within a period of six weeks duly providing opportunity to the petitioner. When the third respondent did not pass final orders, the petitioner filed the present Writ Petition.

The third respondent being a subordinate to the second respondent ought to have complied with the orders passed by the second respondent. The third respondent did not pass final orders nor conducted any enquiry after the orders dated 22.05.2015, as per the submission of the learned counsel for the petitioner, except issuing a notice to conduct an enquiry against the petitioner. In the circumstances, the third respondent is directed to complete the enquiry, and pass final orders thereon, within a period of fifteen days from the date of receipt of a copy of this

order.
